Cancellation Policy

Right of Cancellation

Consumers have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of cancellation, you must inform us (Smoky GmbH, poststr. 5/1, 69115 Heidelberg, Email:support@smokyhotbox.de) by means of a clear statement (e.g. by email or post) of your decision to cancel this contract.

You may use the sample form below for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning the exercise of the right of cancellation before the cancellation period has expired.

Effects of Cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notice of your cancellation of this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is earlier.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your cancellation of this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this diminished value results from handling the goods in a way that is not necessary to check their nature, characteristics and functioning.

Exclusion or Premature Expiry of the Right of Cancellation

The right of cancellation does not apply to contracts for the supply of goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

The right of cancellation expires prematurely in the case of contracts for the supply of sealed goods if their seal has been removed after delivery.
